Terms & Conditions of Use

Welcome to Wavetail Media. Please read these Terms and Conditions of Use carefully before using our services. By accessing or using our services, you agree to comply with and be bound by these Terms and Conditions. If you disagree with any part of these terms, please do not use our services.

General Terms
1. The term ‘Wavetail Media,’ ‘us,’ ‘we,’ or ‘our’ refers to the owner of the website and the podcast service company. Our mailing address is 2334 Emerald Street, Rocka 2 Village, Tabang, Plaridel, Bulacan, Philippines. Wavetail Media is registered in Bulacan, Philippines. The term ‘you’ refers to the user or viewer of our services.
2. Our services include podcast editing, image creation, show notes, and other related services as listed on our website and discussed in communication with our clients.
Use of Services
1. By using our services, you agree to comply with all applicable laws and regulations.
2. You must be at least 18 years old or the legal age in your jurisdiction to use our services.
3. You are responsible for providing accurate and current information when using our services, including but not limited to your contact details and payment information.
Communication and Subscriptions
1. By creating an account or using our services, you agree to receive newsletters, marketing materials, and other communications from us. You may opt out of these communications at any time by following the unsubscribe link or instructions provided in the email.
2. If you wish to purchase any of our services or products, you may be asked to provide certain information relevant to your purchase, including billing and shipping details. You represent and warrant that the information you provide is true, correct, and complete.
Refunds and Cancellations
1. Wavetail Media does not offer refunds on prepaid subscription services. Services are provided in the month they are purchased and are non-accumulative. Any unused portion of the service will not be credited or refunded.
2. Clients may cancel their subscription before the next billing cycle, which occurs during the first week of the month. Cancellations will apply to future invoices only and will not remove the responsibility to pay any outstanding balances on past invoices.
Content Usage Rights
1. Wavetail Media does not claim ownership rights to the content provided by clients for editing purposes.
2. However, by using our services, clients grant Wavetail Media the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute the edited content for marketing and promotional purposes. This license includes the right to make the content available to other users of our services, subject to these Terms and Conditions.
3. Music, voice over, and other files used in the podcast episodes, intro, outro, and mid-roll are the sole responsibility of the client to ensure that they possess the necessary licenses for their use. This also includes images, videos, and any other licensed content.
4. Wavetail Media shall not be held responsible for any legal issues or lawsuits arising from the client’s use of content, including music, voice over, images, videos, or any other licensed material. The client assumes full responsibility for obtaining the appropriate licenses and permissions.
5. Wavetail Media reserves the right to not be included in any lawsuit or legal dispute related to the client’s use of content, including music, voice over, images, videos, or any other licensed material.
Billing and Payment
1. Subscription-based services are billed on a recurring basis. Billing cycles are set either on a monthly or annual basis, depending on the type of service and subscription plan chosen.
2. A valid payment method, such as a credit card or PayPal account, is required to process the payment for your subscription. By providing payment information, you authorize Wavetail Media to charge all subscription fees incurred through your account to the designated payment method.
3. Wavetail Media reserves the right to change service fees upon 30 days’ notice.
Intellectual Property
1. The content, features, and functionality of our services are the exclusive property of Wavetail Media and its licensors. These are protected by copyright, trademark, and other laws.
2. You may not distribute, modify, transmit, reuse, download, repost, copy, or use any content found on our services without express advance written permission from us.
Termination
1. We reserve the right to terminate or suspend your account and deny access to our services immediately and without prior notice, at our sole discretion, for any reason including but not limited to a breach of these Terms and Conditions.
2. You may terminate your account at any time by discontinuing the use of our services.
Limitation of Liability
1. In no event shall Wavetail Media, its directors, employees, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from your use or inability to use our services.
Governing Law
1. These Terms and Conditions shall be governed and construed in accordance with the laws of Bulacan, Philippines, without regard to its conflict of law provisions.
2. Any dispute arising from or relating to these Terms and Conditions or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Bulacan, Philippines.
Changes to Terms and Conditions
1. We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. If we make material changes, we will provide notice prior to the changes taking effect.
2. Your continued use of our services after any revisions to the Terms and Conditions constitutes your acceptance of the updated terms.
